Forgile Terms of Use

This is an English translation provided for convenience. The official text is the Portuguese version, which prevails in case of any discrepancy.

These terms govern the use of Forgile, a platform for learning to code offered by LBA TECNOLOGIA LTDA, CNPJ 41.450.516/0001-15, headquartered at [address] ("Forgile", "we", "us"). By creating an account or using Forgile, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the service.

1. What Forgile is

Forgile offers content, exercises and code execution so you can learn to code by practicing, with explanations of results and errors. The result of an exercise is decided by compilation, execution and automated tests.

2. Account

  • To use the exercises, you need an account, created with an email and password or with your Google account.
  • You must provide truthful information and keep your email up to date.
  • [You must be at least [13] years old. If you are under 18, use Forgile with the knowledge and permission of your parents or guardians, who accept these terms on your behalf.]
  • Your account is personal: do not share your password. You are responsible for what happens in your account until you notify us of misuse at marketing@forgile.com.
  • We may limit login attempts and other actions to protect accounts.

3. Plans, prices and payment

3.1 Free plan

The Free plan has no cost and no time limit, and requires no card. It includes the entire Lógica de programação path, the first two modules of the Java do zero, SQL do zero and APIs REST com Java paths, code execution and grading, 5 hints from Forgy per day and the progress features (XP, ember, daily goal and friends league).

3.2 PRO plan

  • PRO unlocks every path and every module and 50 hints from Forgy per day, plus everything in the Free plan.
  • Features announced as "coming soon" (for example, review of your mistakes, projects with automatic grading and a verifiable certificate) only become part of PRO when they are launched. They are not a condition of the purchase.
  • Prices: R$ 24.90 per month on the monthly plan or R$ 199.00 per year on the annual plan, in Brazilian reais (BRL), charged in advance at the start of each period. [Confirm with the accountant: taxes included in the price and issuing of invoices (Stripe does not issue Brazilian service invoices).]

3.3 Payment

  • Charges are processed by Stripe, a payment company hired by Forgile. The monthly plan is paid by credit card (including through Apple Pay or Google Pay); the annual plan can be paid by credit card or Pix.
  • With Pix, PRO is unlocked when the payment is confirmed, which may take a few minutes. A Pix code not paid within its deadline expires without any charge.
  • Card and Pix details are given directly to Stripe. Forgile does not receive or store your card number (see the Privacy Policy).
  • No paid plan is purchased without your confirmation on the payment screen.

3.4 Renewal

  • The monthly plan renews automatically every month, for the same period, and is charged to the same card until you cancel.
  • The annual plan does not renew on its own, whether paid by card or Pix: each payment unlocks 12 months of PRO. In the last 15 days of the period, you can pay for another year on the plans page, and the new year starts when the current one ends. If you don't renew, the account goes back to the Free plan at the end of the period, without losing progress.
  • [We will notify you by email near the end of the annual plan, at least 7 days in advance. Notice not yet implemented.]
  • If the price changes, we will notify you by email at least [30] days in advance. The new price only applies from the renewal after the notice, and you can cancel before it.
  • If the monthly renewal cannot be charged, Stripe tries again for a few days and PRO stays active in the meantime. If it doesn't work, the subscription ends and the account goes back to the Free plan. Your progress is not lost.

3.5 Right of withdrawal (7 days)

Since the purchase is made online, you can withdraw from PRO within 7 calendar days of the purchase, without giving a reason (Brazilian Consumer Protection Code, art. 49). In that case, we refund the full amount paid, through the same payment method, and the account goes back to the Free plan. The request is made by email to marketing@forgile.com [replace with suporte@forgile.com when it exists]. [Define whether the 7-day period also applies to each renewal.] [Time for the refund to appear: define with Stripe; on a card, it depends on the card issuer.]

3.6 Cancellation

  • You can cancel the monthly subscription at any time, with no fee, on the app's plans page ("Manage subscription") or by email at marketing@forgile.com. The annual plan has no renewal to cancel.
  • Cancelling stops future renewals. PRO stays unlocked until the end of the period you have already paid for; after that, the account goes back to the Free plan, without losing progress.
  • Outside the withdrawal period, there is no proportional refund for the current period, except when required by law or when the service becomes unavailable due to our fault.

4. Permitted use

You agree to use Forgile to learn and practice. You may not:

  • try to escape the execution environment, access other systems or the internet from it, or attack Forgile's infrastructure;
  • submit code designed to mine cryptocurrency, send spam, deliberately consume resources, or any malicious code outside the context of the exercise;
  • automate the use of the platform (bots, data scraping) without permission;
  • try to obtain hidden tests, reference solutions or other people's data;
  • create accounts in bulk or bypass plan limits;
  • publish or send content that is illegal, offensive or that violates third-party rights;
  • resell or redistribute Forgile's content.

Security flaws found in good faith should be reported to marketing@forgile.com, without exploiting them beyond what is needed to demonstrate them.

5. Code execution

The code you submit runs in an isolated environment, with no internet access and with limits on time, memory and output. Execution may fail, take longer or be unavailable. Do not use Forgile to store or run code that is important to you, and do not put personal data, passwords or secrets in exercise code.

6. Content and intellectual property

  • The texts, exercises, tests, explanations, brand, logo and the Forgy mascot belong to Forgile or its licensors. You receive a personal, non-exclusive and non-transferable license to use them for your learning.
  • The code you write remains yours. You authorize us to store, run and display it to you, and to use it in aggregated form, without personal identification, to improve exercises and explanations.

7. Automatic explanations and artificial intelligence

Error explanations and hints help with learning, but they may be incomplete or wrong. [When there are explanations generated by artificial intelligence, they will be identified as such.] Whether your code passes is decided by execution and tests, not by the explanations.

8. Availability and changes

We work to keep Forgile online, but it may be unavailable for maintenance, updates or due to failures. We may change, add or remove features and content.

9. Suspension and termination

  • You can close your account whenever you want, on the Me page ("Delete my account") or by email at marketing@forgile.com. Deleting the account cancels the PRO subscription; any remaining paid period is not refunded, except within the withdrawal period (section 3.5).
  • We may suspend or close accounts that violate these terms, put other people or the service at risk, or when required by law. Whenever possible, we will notify you beforehand and explain why.

10. Liability

Forgile is an educational service. We do not guarantee results such as passing selection processes, getting jobs or certifications. To the extent permitted by law, we are not liable for indirect damages arising from the use or unavailability of the service. Nothing in these terms limits rights you have as a consumer under the Brazilian Consumer Protection Code.

11. Changes to these terms

We may update these terms. Relevant changes will be announced by email or within Forgile [15] days in advance. If you keep using Forgile after that, you agree to the new version; if you do not agree, you can close your account.

12. Governing law and jurisdiction

These terms are governed by the laws of Brazil. The courts of the consumer user's place of residence are chosen to resolve any disputes.
